Best Blogs in Asia - New Start-up

After taking a lot of “feedback” aboard, I’ve decided to revamp the site and allow disassociation from Phil’s Asia Blog Awards, so users can vote on which are the Best Blogs in Asia.

The site offer the following features:

- All voters are able to modify their votes.
- Voters can make a comment in a specific category and post their site for approval in the Voting System.
- Security levels are increased, so cheating would be difficult.
- A dynamic Custom Character is available for each of your posts.
- Each Category has a “Refer to Friend” link at the bottom, you can easily promote your site to your friends/family.

“Best Blogs in Asia” will also be a permanent fixture on Misohoni.

    Giles, I came over from http://www.gweilodiaries.com It was mentioned you actually deleted comments from people who disagreed with you hosting the “Awards”. Is that true?

    I have expressed my unhappiness at someone using an idea I first came up with but on no occasion have I asked him to take it down - in fact I publicly stated I would let the market decide so Boy I think you are dribbling brown stuff out of the corner of your lip.

    By the way, you are wrong on the other front - I do have creative intellectual property rights and they have been infrgined and continue to be, according to two different IP partners of law firms in Hong Kong, even with the name change. However, because there is no revenue of note involved (although my awards did receive some sponsorship money from a doner to help cover the increased bandwidth cost) that is why the matter is as far as I am concerned closed (and after a request from Giles).

    Perhaps copy what he does next - acting maybe? Dead guy No 2? Maybe he’s got copyright on that also!

    Is this award thing more important than being nice to each other. This world is about competition. if you wants ownership of something..go patent it else everyone or should I say anyone who is talented should be given a chance to do things they like or wanted. no???

    Oooh - you made a mistake. I don’t have to apply for anything - by creating this and exploiting it in the public domain the law already grants me Intellectual Property Rights which have been breached.

    Giles did not mean harm even though I think what he has done is wrong and so does every IP expert I have consulted including two partners of rather large Hong Kong law firms. The issues are both moral and legal.

    The electronic evidence of emails saying this was the opening of the 2004 awards because I was “busy” (to quote directly) would make any cease and desist action a slam dunk.

    However, although I say this without prejudice because I was talking to companies about sponsering the next awards and giving it proper promotion and if that goes ahead the situation will change somewhat, for now I am happy to leave it to the market.

    Although I have not met Giles he has always been very generous to me, suggesting new logo designs for my site among other things so I am sad this happened the way it did but I while I am doing nothing now, I must leave open the option of redress because of the one fact I have kept to myself until now: The 2004 awards is going to be its own entity (not hosted on a blog) and there are potential sponsors and believe me they WILL want to protect the IP.

    Phil..I mean no offence, I understand your concern and know jolly well that this is your brain child (the award stuff) but is it really that important than losing one great friend?
    also, morally and legally you might be right about the Intellectual Property Rights but morally do you think all these fighting are necessary?? what are all the motives behind the award thing?? was it becos of fame? or was it doing a service for the public. if its for public, then who ever do it and has the right means of doing it should be encourage to do so. just like encouraging free speech in blogging world isnt it?

    From my point of view, a talented person work should not be put to waste and if everyone agree on that, then whats the point of fighting over it. after all, we all knew that this is your brain child and giles is helping you beautifying it thats all.. what both of you did was a service to the public, and if its a service to the public, whats the importance of who is doing what and who did what first???

    and eshin, no I am not holding hands to sing some stupid songs…and I am glad to see thing that not a lot of people can experience in this lifetime. There are just far more things to be of concern than just sitting over the computer and fighting issues on legally and morally if what you did is not for gain but for the public services.

    Phil, in reply to your post on my site, I think you have a case for fraud or misrepresentations if Giles did in fact position himself as your representative when you had not given him license to do. Under Intellectual Property law it probably constitutes “passing off”.

    But as I said on my site, I don’t believe you can copyright an idea or a name. You may have grounds to establish a trademark for Asia Blog Awards and your logo (or some other graphical representation under UK law) but not for just the concept of running a similar contest. Of course, if he borrowed your list of nominees, that could be grounds.

    But I doubt you can copyright the concept unless you have evidence of passing off, which is an infringement on your trademark and can be construed as fraud. Anyway, take it to the law courts if you feel your case is sufficient based on copyright. I’m not a lawyer.
